§ 2.16.080. Duties-Employees.

    Subject to the provisions of the Home Rule Charter, the city manager shall have the power to employ, reclassify or remove all employees of the city except the city attorney and the city clerk and except as provided herein subject to the provisions of the Soldier's Preference Law (Code, Chapter 70) and the Civil Service law (Code, Chapter 400). Subject to approval of the city council, the city manager shall fix the compensation to be paid such employees except for the city attorney and the city clerk.

    B.

    Prior to termination, the city manager, and if appropriate, the department head, shall hold a termination conference with the employee. The employee shall be given notice of the conference at least three working days before the conference is held. At such conference the reason for the proposed termination will be disclosed to the employee and the employee will be given an opportunity to respond. After the conference the city manager may proceed with termination by sending a written notice of the termination to the employee, either in person or by regular U.S. mail.

    C.

    In the case of all non-civil service department heads, with the exception of the city clerk and the city attorney, the city manager shall hold a termination conference with said department head. The employee shall be given notice of the conference at least three working days before the conference is held. At such conference the reason for the proposed termination will be disclosed to the employee and the employee will be given an opportunity to respond. If the city manager proceeds with termination, a written notice of the termination shall be provided to the department head, either in person or by regular U.S. mail.

    D.

    In the case of emergencies, extraordinary circumstances or until a termination conference, the city manager may immediately suspend the employment of an employee either with or without pay.

    E.

    Upon the recommendation of the city manager, the removal of the police chief or the fire chief shall be considered by the city council. Should said chief request it, a closed session may be held regarding the reason for the removal from the position. If such removal is approved by a majority of the city council, a written order of removal consistent with Iowa Code Section 372.15 shall be sent to said chief. The chief may then request a public hearing in front of the city council as outlined by that section.
